Social Reformations in Policing, Law & Order - The need of the Hour

My dear friends,

Let us look in to various reasons of Communal disturbances, Riots and Violence and social injustice.
Majority of these cases directs to failures of Government’s development process to help the society, negligence of people’s requests, needs, suppression of people’s freedom to act on their fundamental rights, misuse of official machinery & power, lack of assessments on issues threatening law & order, bi-partisan opinions from Intelligence agencies, lack of local support, difference of opinions between State & Central approach,
Improper track record of offenders, habitual law breakers, anti – social elements, Political pressures, Rich & Influential interferences in law enforcing officials functioning, Corruptive practices within society & law enforcing authorities, discriminations within the society on communal grounds etc.,
The way some of the Police officials handling the sensitive issues and the political bosses pressures led to massive break down in Law & Order.

Some times Police themselves instigate violence to settle scores with their counterparts.

The criminal law systems in our country totally failed and the manner in which the trial in riot cases proceeded is unthinkable in any civilized society. It amounts total wiping out the rule of Law.

Our Indian Police systems are designed to maintaining order & enforcing Law rather than serving to the people.
However “Order maintenance” translates in to perpetuation of existing social & political order.

The policing objectives are to maintain this status quo.

Also the criminal justice system & in particular the police remains unchanged for the last 140 years, hence the behaviours of the personal also not changed.
Any attempts to change their situations met with protests and outrage by the other.

Police officials and Politicians see themselves as the rulers & guardians of the state, emphasizing order maintenance rather than service to people.

It is for this reason too that even though many laws have been enacted to promote social equality & remove long existing social oppressions & the police do not enforce them.

A pity that many of our Police officials are ignorant of laws pertaining to un-touchablity, bonded labour, Minimum wages act, money laundering, and exploitation of women & children’s etc.,

In spite of plenty of social legislations enacted to protect weaker sections from exploitations, police remains indifferent to these.
The Poor & weaker sections too have the feeling that Police will act only on those complaints from upper class, influential, rich and political backings.

Those N.G.O’s and elite people who supports for the right cause on human rights and against exploitations of weaker sections are being targeted & treated as anti social or traitors & being arrested, harassed and put behind bars without any trial in the court of Law.
Take the case of Dr.Binayak Sen & others who helped the rural tribal of Orissa slogs inside the jail without any proper trial & investigations.
They were not allowed to represent their grievances and fight for justice.
The efforts to fight for social cause & help to improve tribal welfare are being misunderstood by the state law enforcing agencies due to their own political & abuse of power ego.

Where as, whenever cases of torture, abuse of force, or corruption are exposed the government and senior officers describe it as an individual act of aberration. Never has any police leader admitted that such actions are endemic and an example of organizational deviance and practices. Brutality, corruption, and illegality within the Indian police are well recognized and pervasive. This behavior exists within every rank, from the constable to the chief of police and in every police department of the country.

It needs to be pointed out that many courageous officers refuse to act against industrial or rural labour in their struggles with the ruling classes. But this happens very rarely.
 
In most cases the police quickly arrest the workers and break up protests using whatever force is necessary.

Present trend in which Officers openly declare their intentions of pursuing power, the perks of office, and status in society. When this is the situation for the IPS officers who are educated and amongst the best police recruits in the country, then the situation for subordinate police officers can just be imagined.

When we come in to our Political bosses, it is still more pitiable & agonizing experience to many of us.
As those corrupt opportunist political bigwigs wants to score their personal vengeance and anger by instigating false cases against their opponents and use Police for their own selfish reasons.

Those officers who are straight forward and law abiding do not budge to these demands faced with transfers, departmental punishments with false accusations & cases, de promotions and posted in lesser important postings.

Hence the need to reform the entire law proceedings, investigation procedures, improvement of training, updated technological data’s, modern weaponry to handle anti social elements and terrorist outfits, independent decision making powers depending upon the situations, faster trials & case handling in the judicial department, stricter punishments to the guilty, user friendly formats to book cases and eliminations of influences when dealing with crime and law.

Can we expect such reformations and experience the people friendly policing in our future?
