My dear friends,
With lot of confusions and brick batting the UPA government started thinking now to introduce some modifications before submitting itself to the INDO – US Nuke Deal, by some interim amendments to counter effect the much dreaded Hyde Act after BJP came out the proposal to amend once this government is defeated in the Vote of Confidence.
Although BJP mooted the idea of introducing a parliamentary legislation as an appropriate counter resolutions to safe guard our nation’s interest by introducing some ways and means to tackle Hyde Act .
It has not specified the changes they are going to implement and now that the Congress led government facing the final verdict of survival on coming 22nd July 19, 2008 & wishes to tide over all the opposition’s moves against the deal.
They could have thought this much earlier and saved the Left parties coalitions.
(Now the government is "open to the idea" of amending the Atomic Energy Act to counter the Hyde Act which critics see as a legislation that puts shackles on India's right to conduct nuclear tests.)
It is strange to note that UPA Government is fully aware of the implications (of 123 agreement & Hyde Act) by signing the agreement with US on Nuke Deal and why it has not disclosed to its own allies as well as discussed it in parliament with opposition parties to arrive at consensus.
According to Congress party the existing pattern of 123 agreement & Hyde Act cannot damage our country’s interests.
Recently our Finance Minister P.Chidambaram addressing a gathering at prestigious NALSAR University, mentioned that ''When the 123 agreement is ratified by the US Congress, it will be the last expression of the legislature on the subject and will prevail over any earlier domestic law. Under Article VI(2) of the US Constitution, all treaties made or which shall be made under the authority of the United States shall be the supreme law of the land.” The Hyde Act, which is a domestic law, cannot bind India and cannot interfere with the implementation of the 123 agreement. When ratified by the US Congress, it will be a bilateral treaty between two sovereign countries. Referring to Article 16(4) of the 123 agreement, he said, ''the agreement shall be implemented in good faith and in accordance with the principles of international law. Under customary international law as well as the Vienna Convention on Law of treaties, a party may not invoke provisions of its internal law as justification for its failure to perform a treaty.'' ''The 123 agreement has not come into force and even after it happens, India and USA will have to enter into further agreements to fulfill the objectives on industrial and commercial scale,'' he said, expressing disappointment on as to why the issues were not being raised and answered in a logical and rational manner. ''The agreement is only an enabling agreement and no more,'' he said, adding for operationalising it, both the countries had to complete pre-requirements, exchange diplomatic notes and agree upon the date on which it would come into force.
Where as after the number of objections from various media, policymakers, political parties, scientists, economists and professionals, the UPA government has come down from its stand and started thinking on the much awaited amendments by a domestic law to counter the threat as well as to take control of the situations to win the vote of confidence.
The Government had so much time in the last 4 years and were not bothered about this deal and when the situations in the nation went beyond their control by the spiraling prices of commodities, crude oil escalations in global price, shooting inflation rates, terrorism, and naxalite menance etc, they have taken this deal as important issue to sideline the rest of the burning issues.
Politicians will play their old games and continue to flip flop as it suits them. Only those among them who recognize the inevitabilities of the information age will display total transparency to project their views. They will be the statesmen who achieve a new level of democracy to change the world.
One should recall the visit few months back to our nation by Dr.Henry Kissinger in the thick of the nuclear deal controversy. He met with senior politicians opposed to the deal.
The newspapers assumed he had come to push India into signing the deal.
It is reliably learnt that at least one of the opposition leaders he met was left puzzled by Kissinger not raising the subject of the deal even once.
Then why did he come?
Quite possibly his visit was a cosmetic exercise to appear on the side of the deal which he might have calculated was unstoppable.
It is good politics to be on the winning side.
Subsequent to his Indian visit Kissinger, after making a hash of nuclear non-proliferation through the kind courtesy of Dr AQ Khan, is now working to achieve global nuclear disarmament.
Don’t forget to remember that the names of Dr.Henry Kissinger & our Prakash Karat were short listed by an NGO (Arms Control Association (ACA) a powerful American NGO propagating non-proliferation. This organization gives an annual award for the most effective work favouring global nuclear non-proliferation.) as the nominee for the award for their efforts to block the Indo-US nuclear deal. Eventually Karat did not receive the award. But becoming a nominee for this award was itself prestigious.
The point is when our government was maintaining such secrecy over the IAEA text, some websites leaked it in open, it may be some vested interests of the one who does not wants the deal…

As the “D” Day nearing, all political forces are trying to vie each other with new promises, assurances and amendments and Congress Led UPA undergoes nightmare to muster the magical numbers 272 to survive & remain in power.
Let us wait and watch.

Every member of the existing parliament are going to face their music in the next forthcoming elections.
How many of them are going to get their re-election tickets itself in doubt.
Even if they get, how are they going to win is another puzzle.
No party at this stage has the convictions and courage to face the voters as their positions are at stake.

What is sown has to be reaped and congress party is not an exception.
What it has done all these years of ruling is well known fact.
The utter failures and scams are yet to erase from our minds.
Gone are the days where politics had a morality and public service.
Let the regional & national parties learn their lessons atleast now.
The unholy marriages of various parties just to remain in power will face its waterloo.
Hope we get back our Late Sri.Morarji Desai's golden era in the future.

It is clear that battle lines drawn and fall of UPA Government is imminent as the latest reports of RJD, JDS and rebels joined the hands of opposition to UPA Govt.
Let this lesson reassure us that actions of any government should be on priorities of National importance and there is a hope that 123 agreement & Hyde Act provisions are to be re negotiated to safe guard our nations interests.
The forthcoming elections are going to be a nightmare to all the parties.

Congress is the most untruthful party that i have seen in my lifetime. Every party has some skeletons to hide. But for congress, even a huge vault will not be enough for hiding its skeletons. It is a sorry state that it comes back to power every now and then.
